From 1st October 2014, salary protection will not be available to any award that has been withdrawn or not successfully renewed and so your pensionable pay needs to be protected.
Where pensionable pay reduces from 1st October 2014 because mark time pay in respect of a former award has ceased, it has been agreed that pensions can be protected.
Similarly, if your current award is not renewed (National DAs and CEAs are subject to application for renewal every 5 years) for whatever reason, it has been agreed that pension protection can be considered.
What To Do?
In particular, if you are a consultant who has lost their DA or CEA or not had it renewed, NHS Pensions will consider applications for pension protection. You should apply for this via the SMR9 and SMRE9A forms which are available on the NHS Pensions website.
Members of the 1995 Section should provide the best of the last 3 years pensionable pay up to the date of the reduction.
