HMRC have confirmed that Enhanced Protection, Fixed Protection 2012, Fixed Protection 2014 will all be lost if doctors move to the 2015 NHS Pension Scheme and make even a single contribution.
This is because moving to the 2015 NHS Pension Scheme is considered moving to a new pension scheme and HMRC considers this a trigger for the loss of the protections for the reduction in the Life Time Allowance for pension purposes.
To safeguard against the loss of protection, it is possible to opt-out of the 2015 NHS Pension Scheme (please remember this is not a decision to be taken lightly and requires a thorough appraisal of your financial circumstances).
However, if you are currently an active member of the 1995 or 2008 NHS Pension Schemes you must opt-out no later than your final month in that Scheme. To ensure you do not automatically move to the 2015 NHS Pension Scheme and then lose the protection, you must therefore opt out by no later than the end of March 2015.
